HERSHEY, Penn. — A 13-year-old boy was denied consideration for admission to the Milton Hershey School because he is HIV positive. The boy has since filed a lawsuit in federal court against the school.
It has been reported that school officials believe the boy would be a threat to the health and safety of others students on campus, the Delaware County Daily Times reports. According to the school’s court filing, “the School believes that the risk of transmission of HIV to other students through consensual sexual conduct meets the standard of a direct threat to the health and safety of others that cannot be mitigated through reasonable modifications to its policies, procedures and practices.”
Due to privacy issues, neither staff nor other students will be allowed to know the boy is HIV positive.
