A former University of Massachusetts (UMass) Amherst student is suing the school, claiming he wasn’t treated fairly when he was accused of sexual assault.
The student claims he was ordered to leave the school over allegations he had sexually assaulted a female student, reports the Boston Globe. He says he was discriminated against because he was a man and that the university violated his rights under Title IX.
The lawsuit alleges UMass rushed to judgment when it found the plaintiff responsible for the assault. He is suing for damages and wants UMass to expunge his record.
The lawsuit claims the plaintiff and an unidentified female student had consensual sex after a night of drinking where the female didn’t show signs of being drunk. The following day, the female student didn’t remember what had happened the night before. She then was evaluated at the campus health center and then filed a complaint.
The plaintiff alleges that during the disciplinary hearing some evidence wasn’t presented, he was frequently interrupted and his questions were ignored. He also says he wasn’t provided with documents before the hearing.
